بتنزيلك تطبيق «فطنة» أو تثبيته أو استخدامه، فإنك توافق على الالتزام بهذه الشروط المبرمة بينك وبين مطوّر تطبيق «فطنة» (مطوّر فردي مستقل) («نحن»). إن لم توافق عليها فلا تستخدم التطبيق.
نمنحك ترخيصاً محدوداً، غير حصري، غير قابل للتحويل، وقابلاً للإلغاء، لاستخدام التطبيق لأغراض شخصية غير تجارية على أجهزة تحمل علامة Apple تملكها أو تتحكم بها، وفقاً لقواعد الاستخدام الواردة في شروط خدمة App Store.
يُحظر عليك: إجراء هندسة عكسية للتطبيق أو فك تجميعه أو تفكيكه، أو تعديله أو إنشاء أعمال مشتقة منه، أو إعادة بيعه أو تأجيره أو إعارته، أو استخدام أدوات آلية أو كشط بياناته، أو الالتفاف على الميزات المدفوعة أو أنظمة الحماية، إلا بالقدر الذي يجيزه القانون النافذ صراحةً.
يجب ألا يقل عمرك عن ١٣ عاماً لاستخدام التطبيق (أو السن الأدنى المعتمد في بلدك). عند إنشاء حساب تلتزم بتقديم معلومات صحيحة، وأنت مسؤول عن جميع الأنشطة التي تتم عبر حسابك وعن الحفاظ على سرية وسائل الدخول إليه.
أي مزايا أو عناصر افتراضية داخل التطبيق ليست لها قيمة نقدية في العالم الحقيقي، وهي غير قابلة للتحويل لأشخاص آخرين، ولا يمكن استبدالها نقداً.
أنت مسؤول عن الأسماء والأسئلة والمحتوى الذي تدخله في التطبيق (مثل أسماء الفرق والفئات العائلية). يُحظر إدخال محتوى مسيء أو تشهيري أو منتهك لحقوق الغير أو مخالف للقانون. بإدخالك المحتوى تمنحنا ترخيصاً غير حصري لعرضه داخل اللعبة لغرض تشغيلها، ويحق لنا إزالة أي محتوى مخالف دون إشعار.
يُحظر: الغش أو استغلال الأخطاء البرمجية للحصول على مزايا غير مشروعة، أو مضايقة الآخرين، أو استخدام التطبيق لأي غرض غير قانوني، أو انتهاك حقوق الملكية الفكرية لأي طرف.
يبقى التطبيق وجميع محتوياته — بما في ذلك الاسم والشعار والأسئلة والتصميم والرموز البرمجية — ملكاً حصرياً لـمطوّر تطبيق «فطنة» (مطوّر فردي مستقل) أو مرخّصيها، ولا يمنحك هذا الترخيص أي حق ملكية فيها.
يخضع استخدامك للتطبيق أيضاً لاتفاقية ترخيص المستخدم النهائي للتطبيقات المرخّصة من Apple (Licensed Application EULA) وشروط App Store السارية.
يجوز لنا تعديل التطبيق أو ميزاته أو تعليقها أو إيقافها كلياً أو جزئياً في أي وقت، كما يجوز لنا تحديث محتوى الأسئلة وإضافته وحذفه.
يُقدَّم التطبيق «كما هو» و«كما هو متاح» دون أي ضمانات من أي نوع، صريحة أو ضمنية، بما في ذلك ضمانات الملاءمة لغرض معيّن أو عدم الانتهاك أو استمرارية التشغيل بلا انقطاع أو خلوّه من الأخطاء، وذلك إلى أقصى حد يجيزه القانون.
إلى أقصى حد يجيزه القانون، لا نتحمل المسؤولية عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة، ولا يتجاوز إجمالي مسؤوليتنا تجاهك المبالغ التي دفعتها لنا خلال الاثني عشر شهراً السابقة للمطالبة. لا يُقصد بهذا القسم استبعاد أي مسؤولية لا يجيز القانون استبعادها.
توافق على تعويضنا وإبراء ذمتنا من أي مطالبات أو أضرار أو نفقات (بما فيها أتعاب المحاماة المعقولة) تنشأ عن إخلالك بهذه الشروط أو عن المحتوى الذي تدخله أو عن إساءة استخدامك للتطبيق.
يمكنك إنهاء هذه الاتفاقية في أي وقت بحذف التطبيق وإلغاء اشتراكك. ويجوز لنا إنهاء ترخيصك أو تعليقه إذا أخللت بهذه الشروط. تبقى الأقسام ٩ و١٢ و١٣ و١٤ و١٧ سارية بعد الإنهاء.
تخضع هذه الشروط لقوانين دولة الكويت وتُفسَّر وفقاً لها، وتختص محاكم دولة الكويت بالفصل في أي نزاع ينشأ عنها، دون الإخلال بأي حقوق إلزامية تمنحها لك قوانين بلد إقامتك.
قد نحدّث هذه الشروط من وقت لآخر؛ وسنخطرك بالتغييرات الجوهرية داخل التطبيق أو عبر هذه الصفحة مع تحديث تاريخ «آخر تحديث». استمرارك في الاستخدام بعد سريان التغييرات يعني قبولك بها.

By downloading, installing, or using the "Fatinah" app, you agree to be bound by these terms, concluded between you and the independent individual developer of Fatinah ("we", "us"). If you do not agree, do not use the app.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in the App Store Terms of Service.
You may not: reverse engineer, decompile, or disassemble the app; modify it or create derivative works; resell, rent, or lend it; use automation or scrape its data; or circumvent paid features or protection mechanisms — except to the extent expressly permitted by applicable law.
You must be at least 13 years old to use the app (or the minimum age in your jurisdiction). When creating an account you agree to provide accurate information, and you are responsible for all activity under your account and for keeping your credentials confidential.
Any in-app benefits or virtual items have no real-world monetary value, are non-transferable to others, and cannot be redeemed for cash.
You are responsible for the names, questions, and content you enter into the app (such as team names and family categories). Entering content that is abusive, defamatory, infringing, or unlawful is prohibited. By entering content, you grant us a non-exclusive license to display it within the game for the purpose of operating it, and we may remove any violating content without notice.
The following are prohibited: cheating or exploiting bugs for illegitimate advantage, harassing others, using the app for any unlawful purpose, or infringing anyone's intellectual property rights.
The app and all its content — including the name, logo, questions, design, and code — remain the exclusive property of the independent individual developer of Fatinah or its licensors. This license grants you no ownership rights.
Your use of the app is also subject to Apple's Licensed Application End User License Agreement and the applicable App Store terms.
We may modify, suspend, or discontinue the app or any of its features, in whole or in part, at any time, and we may update, add, or remove question content.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR ERROR-FREE PERFORMANCE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages, and our total liability to you shall not exceed the amounts you paid us in the twelve months preceding the claim. Nothing in this section is intended to exclude liability that cannot be excluded by law.
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these terms, the content you enter, or your misuse of the app.
You may terminate this agreement at any time by deleting the app and cancelling your subscription. We may terminate or suspend your license if you breach these terms. Sections 9, 12, 13, 14, and 17 survive termination.
These terms are governed by and construed in accordance with the laws of the State of Kuwait, and the competent courts of Kuwait shall have jurisdiction over any dispute arising from them, without prejudice to any mandatory rights granted to you by the laws of your country of residence.
We may update these terms from time to time; we will notify you of material changes in the app or on this page and update the "Last updated" date. Continued use after changes take effect constitutes acceptance.
